By creating an account or using TestiPull (the "Service"), you agree to these Terms of Service. If you do not agree, do not use the Service. The Service is operated by Christopher Kurr (see Imprint for contact details).
You must be at least 16 years old to create an account. You are responsible for keeping your credentials confidential and for all activity under your account. Notify us immediately if you suspect unauthorized access.
TestiPull lets freelancers and agencies collect, approve, and embed client testimonials. You agree to use the Service only for lawful purposes and in compliance with all applicable laws and regulations.

You retain ownership of the testimonials and content you collect through the Service. By using the Service, you grant TestiPull a limited, non-exclusive license to host, store, and display your content solely for the purpose of operating the Service.
You are responsible for obtaining all necessary consents from the individuals whose testimonials you collect, including consent to publish their name and testimonial content publicly. The Service includes a consent checkbox on the submission form for this purpose.
FTC notice (US): Testimonials must reflect the honest opinions, findings, or experiences of your clients. You are responsible for complying with the FTC Endorsement Guides, including disclosing any material connection between you and the person giving the testimonial.
Payments are processed by our payment provider Polar (polar.sh), who acts as Merchant of Record. Subscriptions renew automatically unless canceled before the renewal date. Lifetime plans are one-time purchases and are non-refundable after 14 days unless required by applicable consumer law.
Prices are shown in US Dollars and may change with prior notice. Existing paid plans will not be affected by price changes until renewal.
If you are a consumer residing in the European Union, you have the right to withdraw from a paid subscription within 14 days of purchase without giving any reason, unless you have already begun using Pro features (in which case, by starting to use the Pro features, you expressly consent to the immediate execution of the contract and acknowledge that you lose your right of withdrawal).
You may cancel your account at any time from your dashboard settings. We may suspend or terminate accounts that violate these Terms. Upon termination, your data will be deleted in accordance with our Privacy Policy.
The Service is provided "as is" and "as available", without warranties of any kind, express or implied, to the fullest extent permitted by law. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.
To the fullest extent permitted by law, TestiPull's total liability for any claim arising out of or related to the Service is limited to the amount you paid in the 12 months preceding the claim. We are not liable for indirect, incidental, consequential, or punitive damages. Statutory liability for intent and gross negligence remains unaffected.
We may update these Terms from time to time. Material changes will be communicated via email or via a notice on the Service at least 14 days before taking effect. Continued use after the effective date constitutes acceptance.
These Terms are governed by the laws of the Federal Republic of Germany, excluding its conflict-of-law rules. If you are a consumer in the EU, mandatory consumer protection laws of your country of residence apply.
